1. Who we are
ClinIQ Ireland (“ClinIQ”, “we”, “us”) provides an AI-assisted clinical reasoning and research platform for qualified Irish healthcare professionals. ClinIQ is operated by [TODO: confirm legal entity name and registered address], Ireland. Contact: info@cliniq.ie.
2. Who may use ClinIQ
ClinIQ is provided only to qualified healthcare professionals who are currently registered with the Irish Medical Council (IMC), Nursing and Midwifery Board of Ireland (NMBI), Pharmaceutical Society of Ireland (PSI), CORU, or an equivalent regulator, or who are bona-fide doctors-in-training, medical students, or healthcare researchers in Ireland or the EU/UK.
You must be at least 18 years old. By creating an account you confirm that you meet these conditions and that the information you provide is accurate. We may suspend or terminate accounts where these conditions are not met.
3. Not a medical device; not a diagnosis
ClinIQ is an educational and clinical reasoning support tool. It is not a medical device within the meaning of EU Regulation 2017/745 and is not certified for diagnostic or treatment use. ClinIQ does not:
- diagnose, treat, prescribe for, or manage any patient;
- replace clinical examination, professional judgement, or specialist consultation;
- provide emergency advice or substitute for emergency escalation;
- relieve you of your professional, regulatory, or local-protocol responsibilities.
You remain the treating clinician. You are responsible for every clinical decision you make. Outputs may be incomplete, out-of-date, or wrong. Always verify against current authoritative guidance (HSE, HPRA, NICE, BNF, specialty guidance) and your local protocols.
4. Acceptable use
You agree NOT to:
- upload or enter directly identifiable patient data (names, MRNs, PPS numbers, faces, contact details, Eircodes, DOBs);
- use ClinIQ in place of urgent or emergency assessment;
- use ClinIQ outside your scope of practice;
- share your account credentials, or allow non-eligible users to access ClinIQ through your account;
- reverse-engineer, scrape, or attempt to extract the underlying models, prompts, or training data;
- use ClinIQ to generate content that is unlawful, defamatory, discriminatory, or in breach of professional ethics.
5. Subscriptions and payment
ClinIQ Pro costs €19.99 per month, billed in advance via Stripe. Subscriptions renew automatically each month unless cancelled. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. See our Refund & Cancellation Policy for refund terms and your statutory rights.
6. Intellectual property
The ClinIQ platform, including its design, code, prompts, and brand, is owned by us or our licensors. You receive a personal, non-transferable, revocable licence to use ClinIQ during your subscription. Outputs generated for your queries may be used in your professional practice subject to your own clinical verification and these Terms; you retain responsibility for any onward use.
7. Limitation of liability
To the maximum extent permitted by Irish law, ClinIQ is provided “as is” without warranty of fitness for any clinical purpose. We are not liable for any clinical outcome, patient harm, regulatory complaint, or third-party claim arising from your use of ClinIQ. Our aggregate liability to you in any 12-month period will not exceed the fees you paid us in that period.
Nothing in these Terms limits liability that cannot be limited under Irish or EU consumer law, including for death, personal injury caused by negligence, or fraud.
8. Privacy
We process personal data in accordance with our Privacy Policy. You are responsible for ensuring that any case information you enter is properly de-identified before submission.
9. Termination
We may suspend or terminate your account at any time for breach of these Terms, fraud, regulatory concerns, or non-payment. You may cancel your account at any time from settings. On termination, your access ends immediately; we may retain limited records as required by law or for audit.
10. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Ireland. The Irish courts have exclusive jurisdiction, subject to any non-waivable consumer rights you have under Irish or EU law.
